  • The following terms are written in plain English and are in addition to eBay's 'Commit To Buy' disclaimer as noted below:
    You are agreeing to a contract -- You will enter into a legally binding contract to purchase the item from the seller. You are responsible for reading the full item listing, including the seller's instructions and accepted payment methods. Seller assumes all responsibility for listing this item.
Shipping and Delivery
  • It is the buyer's responsibility to ensure their eBay shipping address is correct at time of payment and returned items will be subject to a re-delivery cost.
  • Once items are posted, they are then the responsibility of Australia post and International Postage services and are subject to their transit times and delays.
  • Any delivery date advice given via eBay or Atomic Cherry is an estimate only and not guaranteed.
  • In the case of late delivery or missing items, we promise we will do all we can to investigate the whereabouts of the parcel.
  • If a buyer chooses not to insure their item, Atomic Cherry cannot be held liable for any loss or damage in transit. Items are sent at the Buyer's own risk. Registered Post (Insurance) is highly recommended.

    International Buyers - Important Information Regarding Customs Charges, Transit Times and Insurance
  • International buyers purchase with the knowledge their order is being sent from Australia and can take between one to
    eight weeks to arrive depending on the location.

    Customs Charges:
  • International orders will most likely be subject to import taxes, customs duties and fees levied by the destination country.
  • Additional charges for customs clearance must be borne by the buyer.
  • Atomic Cherry are unable to advise what these charges will amount to. Each country sets different fees and taxes and the buyer should contact their local customs office for further information.
  • These fees are levied once a shipment reaches the destination country and goods will not be released until said charges are paid in full.
  • The buyer is responsible for ensuring that the product can be lawfully imported to their country.
  • Customs clearance procedures can cause delays and should be taken into account.

Purchases and Payment
  • We require instant payment on all items. An item is not considered sold by eBay until payment has been received.
  • Orders may be cancelled at anytime via written correspondence.
  • Combined postage and payment is available for multiple purchases. Multiple items need to be purchased via the eBay Shopping Cart
  • Goods will not be despatched until payment including shipping costs have been received in full.

PayPal Payments
  • All payments processed through PayPal and are conducted subject to PayPal's User Agreement For PayPal Service.
  • Atomic Cherry accepts no liability for non-completion of any transaction due to PayPal faults, internet connectivity problems or PayPal policy changes and is under no obligation to dispatch goods until full payment has been received in any case.

Late or Non-Deliveries

Unfortunately, despite our best efforts, sometimes items are not delivered as and when intended for various reasons, including:
- Incorrect or incomplete delivery address
- Non-collection of post office pick-ups within required time frame
- Australia Post transit delays due to error, natural disasters and public holidays
We will contact the buyer when a parcel has been returned to us due to a failed delivery.
Returned items will be subject to a re-delivery cost.

Oversold Items
  • We maintain a strict inventory system but sometimes mistakes do happen.
  • In the event of stock being oversold, we will contact you and advise of our error.
  • We will advise if we have any other colours or sizes available of the item you ordered.
  • We will also advise if the item is on order and its expected delivery date.
  • You have the option of changing your order, waiting on new stock to arrive or receiving a full refund/order cancellation.
  • We will do our best to re-source sold out items although we can give no guarantee of future availability of any item.
  • Our liability is limited to a refund of the purchase price of the item and any shipping costs already paid.
Items Sent In Error
  • We maintain strict controls over our picking and packing systems but sometimes mistakes do happen.
  • If you have been sent an incorrect item, please contact us.
  • We will express post the correct item to you as soon as possible and will include a pre-paid satchel for you to return the incorrect item to us.
Faulty Goods
  • All goods that are found to be faulty will either be replaced as soon as possible or a refund will be processed.
  • Please contact us within seven days of receipt of goods and we will rectify the situation.
  • If you are not happy with your purchase, contact is expected before any neutral or negative feedback is left.
  • We are committed to 100% customer satisfaction and will do everything possible to resolve all issues big or small.
  • Once you receive your item, please check that you are happy with it and leave us positive feedback if you wish.
  • Our feedback is left as soon as payment is received.
Returns - Refunds and Exchanges
  • We are happy to offer a refund or exchange for store credit within thirty days of purchase.
  • Returns are be subject to the goods being returned to us for inspection and processing.
  • Goods must be returned in their original packaging with all tags attached (where appropriate).
  • Goods received in an unsaleable condition i.e. showing any signs of wear whatsoever, covered in pet hair or with a distinct smell will be rejected and returned to the buyer. Please take care when trying on your item to avoid makeup or deodorant marks.
  • Refunds are for the cost of the goods only (excluding faulty items)
  • Any returns received more than 45 days after the original purchase date will have a $5.00 processing fee subtracted from the refund amount

  • Goods & Services Tax (GST) of 10% is included in prices shown as required under Australian taxation law.
  • Purchases delivered to addresses outside Australia are not exempt from paying GST. Those purchasers may apply directly to the Australian Taxation Office for a reimbursement where eligible.
  • All orders are despatched with a Tax Invoice as required under Australian taxation law.
  • Atomic Cherry makes no guarantee that any application for reimbursement of GST will be successful and can accept no liability for this.

  • Atomic Cherry reserves the right to vary these terms and conditions at any time without notice.
  • All sales are deemed subject to the Terms and Conditions in place at the time of the sale
