These Terms and Conditions constitute a contract between the customer (you) and the seller (us), Mr Cycling World Pty Ltd ABN 88 721 600 109 ("Mr Cycling World"). These terms and conditions apply to the ordering, purchase, fulfilment and delivery of products from http://stores.ebay.com.au/mrcyclingworld/, the official eBay store of Mr Cycling World. LIABILITY
Mr Cycling World is not liable for any losses or damages caused by this website or any website linked to or from this website. We reserve the right to refuse any order without giving reason. Upon cancellation of an order we will make all reasonable attempts to contact you using the details provided. All received monies will be refunded using the method received.


 CURRENCY
All orders placed with Mr Cycling World are processed in Australian Dollars (AUD). Non-Australian currency figures are all approximations based on an exchange rate.


 STOCK AVAILABILITY
Mr Cycling World is committed to providing exceptional customer service and quality products. We endeavour to make sure that all products listed on our website are currently in stock and pricing is true and correct, Occassionally, however, we are unable to process your order as a result of an item being unexpectedly out of stock. When this is the case, we will contact you immediately (normally within 24 hours) and offer appropriate alternative options, including cancelling and refunding you for the item no longer in stock.


 DELIVERY
The approximate delivery times are estimates only. Mr Cycling World will not be held accountable for late deliveries or loss or damage relating to late deliveries.In the event that multiple items are ordered, part deliveries may be made where stock is not available. All reasonable attempts to notify you will be made using the details you provided. Please ensure you enter the correct delivery address. Mr Cycling World can not be held responsible for incorrectly entered delivery addresses.


INCORRECT ADDRESS
Mr Cycling World cannot be held responsible for an incorrect address being entered on your order.

Address confirmation is given on the review & buy page in the checkout section of the site. If this is not noticed until after your order is finalised, please contact us immediately.

We will attempt to update any incorrect order details, however due to the fast turnaround of our warehouse, some orders cannot be adjusted. In the case that your order is processed and cannot be updated, please refer to our returns section for more information.


 ACCEPTANCE OF GOODS
The buyer is responsible for inspecting the goods for fault and notifying us within 7 working days of receiving the goods should there be a fault.


 INTERNATIONAL CUSTOMS
Orders where a delivery address is not in Australia may incur a customs or import duty charge. Mr Cycling World do not have any control over these charges or are unable to advise what they will be, as it is based on the regulations of your own country. For further information, please contact your local customs office.

All charges are to be paid by the customer on delivery of order. Orders cannot be returned to sender and Australia will not pay these customs charges on your behalf. If you refuse to pay these charges your parcel may be abandoned, and Mr Cycling World will not be held responsible for any loss of funds as a result of this occurrence.

We cannot mark International orders as a “gift” in order to bypass or reduce any customs fees. This is an illegal practice and as an established business we will not do this. We do not make up the rules, but we do follow them.


 PRICING
Prices are subject to change without notice. There may be duties and taxes added to your package by the destination country. You will be responsible for these upon delivery and are not included in your order total.

All prices are inclusive of 10% GST, when GST applies.


 RETURNS
All returned items are subject to the Returns policy, available here in each listing.


 ORDER CANCELLATIONS AND ORDERS PLACED IN ERROR
As experienced eBay users (both buyers and sellers) our team has tried to purchase an item without realising what we are doing, and it is simply impossible. On a desktop, laptop, iPhone, iPad, whatever it doesn't matter. In other words, if you purchase an item from us, you know exactly what you are doing at the time.

Should you not pay for the item you are legally obliged to, an eBay dispute will be opened against your account. The entire process takes about 10 days, and will result in a strike against your eBay account. This is a process that eBay has put into place exactly for this reason.

Q. “Can't you just ignore my purchase?”
No. If you purchased an item from us, we have to pay ~10% fees on that sale. If you don't pay for the item, we still have to pay for the fees unless we go through the eBay unpaid item process as detailed above. Also, by purchasing an item it often means the item is no longer available for sale on the eBay system, and therefore somebody else can't purchase it, which is not fair to them.

Q. “Can't you just cancel my purchase?”
Generally speaking, no. Instead we go through the eBay unpaid item process as detailed above. There are many reasons behind this decision; it's not to try and be difficult, it's just to follow correct business process. We trust you understand.


 WARRANTIES
Many of our products come with a guarantee or warranty from the manufacturer. In addition, they come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. In other words, we offer warranty on all products sold.
